10-YEAR LIMITED WARRANTY

When ecostucco® products are applied in accordance with Mediterranean Colors, LLC written installation procedures, surface deterioration will be limited as defined in the following section, and any defective materials will be replaced as defined below for a period of up to ten years from the date of installation. Installation cost to repair and/or replace any defective products is solely the responsibility of the installing contractor. Mediterranean Colors, LLC warrants to the original owner that ecostucco® products have been manufactured without defects; that ecostucco® will not delaminate, peel, flake or chip from approved substrates; that the finish will be fade-resistant so long as exterior colors in the 50 shade or higher are adequately sealed with the ecostucco® SILACRETE penetrating sealer.

Mediterranean Colors, LLC is not responsible for structural or design defects; misuse, vandalism, civil disobedience, acts of war; any condition caused by any negligence or accidents in maintaining the system; acts of God, including lightning, hurricanes, tornadoes, earthquakes, fumes, flood, chemical fumes or foreign substances in the atmosphere or by other natural occurrences.

Mediterranean Colors, LLC is not responsible for normal wear and tear resulting from usage. Mediterranean Colors, LLC is not liable for any loss due to delays or any other consequential damages. This warranty is non- transferable.
The installing contractor determines the suitability of the product for intended use and assumes all risks. Purchaser’s and/or User’s sole remedy shall be limited to the purchase price or replacement of this product exclusive of any labor costs.|

The foregoing warranty shall continue for a period of Ten (10) years commencing from the date of final inspection of the system as shown below, provided that the owner gives Mediterranean Colors, LLC written notice of any defects in the system within thirty (30) days from the discovery of such defects.

THIS LIMITED WARRANTY WILL APPLY ONLY IF THE FOLLOWING PROJECT INFORMATION ALONG WITH THE CUSTOMER’S NAME, ADDRESS, AND PHONE NUMBER ARE SUBMITTED IN WRITING TO MEDITERRANEAN COLORS, LLC BY THE INSTALLING CONTRATOR AND AT THE TIME OF THE MATERIAL ORDERING FOR APPROVAL BY MEDITERRANEAN COLORS PRIOR TO THE PROJECT INCEPTION.

1. This Ten-Year Limited Warranty shall be pro-rated as followed for replacement by Mediterranean Colors, LLC with a proven manufacturer’s defect:
   
   

   1. Year One: Replace all products with proven manufacturer’s defect.
   2. Year Two: Replace products valued at 90% of Contractor’s prevailing cost.
   3. Year Three: Replace products valued at 80% of Contractor’s prevailing cost.
   4. Year Four: Replace products valued at 70% of Contractor’s prevailing cost.
   5. Year Five: Replace products valued at 60% of Contractor’s prevailing cost.
   6. Year Six: Replace products valued at 50% of Contractor’s prevailing cost.
   7. Year Seven: Replace products valued at 40% of Contractor’s prevailing cost.
   8. Year Eight: Replace products valued at 30% of Contractor’s prevailing cost.
   9. Year Nine: Replace products valued at 20% of Contractor’s prevailing cost.
   10. Year Ten: Replace products valued at 10% of Contractor’s prevailing cost.
   
   The installing contractor shall be responsible for the difference between Mediterranean Colors, LLC allowance above and the contractor’s retail product replacement price. 2. Mediterranean Colors, LLC’s Limited Warranty is for product replacement only and specifically excludes any installation or labor expenses. No installing contractor or anyone else has authorization to modify this warranty. All installing contractors are independently owned and operated, and all product installations are the sole responsibility of the independent contractor; therefore, it is the responsibility of the independent contractor to employ competent installers to ensure proper installation of the product. Mediterranean Colors, LLC will not be responsible for accidental or consequential damage caused thereby.
   
   
3. All claims under this Warranty must be accompanied with proof of purchase. Failure to strictly comply with the conditions contained in this Warranty will make this Limited Warranty null and void.
   
   
4. MEDITERRANEAN COLORS, LLC HEREBY EXCLUDES ANY AND ALL IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND THERE ARE NO WARRANTIES WHICH EXTEND BEYOND THE DESCRIPTION ON THE FACE HEREFOF.
   
   
5. NO OTHER WARRANTIES EXPRESS OR IMPLIED SHALL APPLY INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. MEDITERRANEAN COLORS LLC SHALL NOT BE LIABLE UNDER ANY LEGAL THEORY FOR SPECIAL OR CONSEQUENTIAL DAMAGES. MEDITERRANEAN COLORS, LLC SHALL NOT BE RESPONSIBLE FOR THE USE OF THIS PRODUCT IN A MANNER TO INFRINGE ON ANY PATENT OR ANY OTHER INTELLECTUAL PROPERTY RIGHTS HELD BY OTHERS.
